Terms of Use

1. Who we are

Thanatos Forge publishes independent iOS applications and games through the Apple App Store. Contact: thanatosforgestudio@gmail.com.

2. License to use our apps

Subject to these Terms and the Apple Media Services Terms / Licensed Application End User License Agreement (or any custom EULA we provide), we grant you a personal, non-exclusive, non-transferable, revocable license to use each app you obtain from the App Store on Apple-branded devices you own or control, as permitted by the Usage Rules set forth in Apple’s terms.

You may not:

• Copy, modify, reverse engineer, or create derivative works of our apps except as allowed by law
• Rent, lease, sell, sublicense, or redistribute the apps
• Bypass, disable, or interfere with security, purchase validation, or access controls
• Use cheats, automation, exploits, or unauthorized third-party tools that harm fair play or our services
• Use our apps for unlawful, harassing, fraudulent, or infringing purposes

3. Apple’s role

You acknowledge that these Terms are between you and Thanatos Forge only—not with Apple. Thanatos Forge (not Apple) is responsible for the apps and their content. Apple has no obligation to furnish maintenance or support. To the maximum extent permitted by law, Apple has no warranty obligation; any claims relating to the apps (product liability, legal/regulatory compliance, consumer protection, intellectual property) are our responsibility, not Apple’s, subject to applicable law.

Apple and Apple’s subsidiaries are third-party beneficiaries of these Terms and may enforce them against you. You represent that you are not located in a country subject to a U.S. Government embargo or designated as a “terrorist supporting” country, and that you are not listed on any U.S. Government list of prohibited or restricted parties.

4. In-app purchases, virtual items & subscriptions

• Optional purchases may unlock content, currency, cosmetics, or remove ads
• Payments are charged to your Apple ID via the App Store; pricing is shown before purchase
• Virtual items and currency have no real-world cash value, are not redeemable for money, and are licensed—not sold—for use only in the relevant app
• Unless required by law, purchases are non-refundable by us; refund requests are handled by Apple under its policies
• We may change, rebalance, or discontinue virtual items with reasonable notice where feasible
• Subscriptions (if offered) auto-renew unless canceled in your Apple ID settings at least 24 hours before the period ends (or as Apple otherwise requires)

5. Advertising

Free or freemium apps may display third-party advertisements. Ad content is provided by partners; we are not responsible for third-party offers, sites, or products. See our Privacy Policy for advertising-related data practices.

6. User content & conduct

If an app allows sharing, usernames, or other user content, you retain rights to your content but grant us a worldwide, non-exclusive license to host and display it as needed to operate the feature. You must not post illegal, infringing, abusive, or otherwise prohibited content. We may remove content or restrict access for violations.

7. Intellectual property

Apps, games, artwork, audio, code, names, logos, and related materials are owned by Thanatos Forge or our licensors and are protected by intellectual property laws. “Thanatos Forge,” related marks, and product names are our trademarks or trade dress. Except for the limited license above, no rights are granted.

8. Disclaimer of warranties

TO THE MAXIMUM EXTENT PERMITTED BY LAW, OUR APPS AND WEBSITE ARE PROVIDED “AS IS” AND “AS AVAILABLE,” WITHOUT WARRANTIES OF ANY KIND, WHETHER EXPRESS, IMPLIED, OR STATUTORY, INCLUDING MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT. We do not warrant that apps will be uninterrupted, error-free, or free of harmful components.

9. Limitation of liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, THANATOS FORGE AND ITS OPERATORS WILL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS, DATA, OR GOODWILL, ARISING FROM YOUR USE OF THE APPS OR WEBSITE. OUR TOTAL LIABILITY FOR ANY CLAIM RELATING TO AN APP OR THESE TERMS WILL NOT EXCEED THE GREATER OF (A) THE AMOUNT YOU PAID US FOR THE APP OR IN-APP ITEMS IN THE 12 MONTHS BEFORE THE CLAIM OR (B) USD $50, EXCEPT WHERE LIABILITY CANNOT BE LIMITED BY LAW.

10. Indemnity

You agree to defend and indemnify Thanatos Forge against claims arising from your misuse of the apps, violation of these Terms, or infringement of others’ rights—except to the extent caused by our own misconduct where prohibited by law.

11. Termination

We may suspend or terminate access to apps or features if you violate these Terms or if we discontinue a product. You may stop using our apps at any time by uninstalling them. Provisions that by nature should survive (including IP, disclaimers, limitations, and indemnity) will survive termination.

12. Changes

We may update these Terms from time to time. The “Last updated” date will change when we do. Material changes may be noted on our website. Continued use after changes constitutes acceptance where permitted by law.

13. Governing law

These Terms are governed by the laws of the United States and the state in which Thanatos Forge primarily operates, without regard to conflict-of-law rules, except where mandatory consumer protections in your country of residence apply. Courts in that jurisdiction will have venue for disputes, subject to applicable law.
